TERMS & CONDITIONS
All customer orders are accepted subject to these terms and conditions. Please read them carefully before submitting your advertising copy; by submitting your copy to us, you
agree to these terms and conditions.
Your attention is drawn, in particular, to the following:
• Any stipulation or condition applying to your submission or order must be clearly incorporated in the written instructions supplied to us, and approved by us.
• Orders for insertion of any advertisement are accept on condition that you grant us the right to publish the material in any medium, including online versions.
• We reserve the right at our discretion to decline to publish, or to omit, suspend or change the position of, the whole or part of any copy otherwise accepted by us for insertion.
• Our liability for any loss or damage resulting from errors or inaccuracies in the printing of, or omission of the whole or part of, any copy is limited as set out below.
• You warrant to us that your copy will not breach any contract or infringe any copyright, trademark or any other right of any third party or render us liable to any claim or
proceedings whatsoever.
• All prices quoted by us for advertising are exclusive of any agency commission or VAT.
1. In these conditions ‘we’ or ‘us’ means Information Publications Ltd (Company regd. 6794151) of The Irwin Centre, Scotland Road, Dry Drayton, Cambridge CB23 8AR.
“Advertising’ or “ Advertisement’ means any promotional copy supplied to us in any format. ‘Advertiser’ means the person seeking to promote their product or service by
advertisement. And ‘you’ means the person placing the order for the insertion of the copy with us, whether that person is the Advertiser, the Advertiser’s representative,
agency, or media buyer. And ‘copy’ means any material submitted for publication. The ‘rate card’ means our rate card in effect at the time of placement of any advertisement
orders, which may include other matters, technical specifications and cancellation deadlines.
2. We will only accept instructions or conditions applying to copy if those instructions or conditions have been clearly supplied to us in writing, in due time before publication,
and they have been approved by us.
3. You hereby grant us the right to publish the copy in Cabinet Maker and any of our other publications, whatever the means or system of production delivery, including online
digital versions.
4. You warrant that:
• In relation to copy, you contract with us as a principal notwithstanding that you may be acting directly or indirectly for an Advertiser as an employee, agent or media buyer or in
some other representative capacity.
• The reproduction and/or publication of the copy as originally submitted or as amended pursuant to details below will not breach any contract or infringe or violate any
copyright, trademark or other personal or proprietary right of any person or render us liable to any claim or proceedings whatsoever.
• Any information supplied by you in connection with the copy is accurate, complete and true.
• In respect of any copy submitted for publication that contains the name or pictorial representation (photographic or otherwise) of any living person that can be identified, you
have obtained the authority of such living person to make use of such name, representation or copy.
• Any investment copy submitted for publication is within the requirements of the prevailing Financial Services legislation and will not render us liable to any claim or
proceedings whatsoever.
• The copy complies with requirements of all relevant legislation for the time being in force or applicable in the United Kingdom (including subordinate legislation, the rules of
statutorily recognised regulatory authorities and the law of the European Union).
• All copy submitted to us is legal, decent, honest and truthful and complies with the British Code of Advertising Practice and all other relevant codes under the general
supervision of the Advertising Standards Authority.
5. We may reject, or require to be amended, or amend, any copy so as (i) to comply with legal or moral obligations place on us or you or any Advertiser, or (ii) to avoid infringing
a third party’s rights, the British Code of Advertising Practice and all other codes under the general supervision of the Advertising Standards Authority or the production and
quality specification stipulated or referred to in the rate card.
6. We have the right at our discretion to decline to publish, or to omit, suspend or change the position of, any advertisement otherwise accepted for insertion. However, we will
use reasonable efforts to comply with your requirements although we give no representation, warranty or undertaking as to the date of insertion, the wording, or the quality of
the colour reproduction of the advertisement..
7. We will not be able to return any copy, artwork or other materials supplied.
8. Where you are the Advertiser’s agent, you warrant that you are authorized by the Advertiser to place the copy with us and you will indemnify us against any claim made by the
Advertiser against us arising from the publication thereof.
9. We shall not be bound to a stop order or cancellation or transfer of copy unless any such instruction is received in writing, and approved, prior to the relevant deadline: for
clarity this being 12 noon on the Friday prior to the publication date. Any such instruction received after the relevant deadline shall not affect your liability for payment for the
advertisement.
10. In the absence of any other specific arrangement between you and us, payment in respect of the advertisement is due in advance of publication, except where we have agreed to
allow credit to you. All applications for a credit account will be subject to a credit check and payment shall be no later than 30 days from date of the invoice.
11. Any query in respect of an invoice must be advised in writing to us within 7 calendar days of the date of invoice, otherwise it will be deemed payable in full. We understand and
will exercise our statutory rights to claim interest and compensation for debt recovery costs under that Late Payment Legislation if payment is not received according to agreed
terms.
12. It is your responsibility to check the correctness of the advertisement (and of each insertion of the advertisement if more than one). Without prejudice to paragraph 6, we
assume no responsibility for the repetition of an error in an advertisement ordered for more than one insertion unless notified immediately the error occurs, and prior to the
deadline for the next scheduled date of publication.
13. Should our liability be proven, it is strictly limited either to publish the corrected advertisement for a second time without additional charge without affecting your liability for
payment by the due time of our charge for the original advertisement, or (at our option) to give you a credit against our charge for the incorrect advertisement.
14. There is no obligation for us to supply voucher copies or tear sheets and their absence shall not affect your liability for the agreed charge.
15. Whilst all reasonable endeavor will be made as soon as possible after receipt by us to forward any replies to box numbers to you or as you may direct, we accept no liability in
respect of any loss or damage alleged to have arisen through delay in forwarding or omitting to forward such replies.
16. You will indemnify us and agree to keep us indemnified against all claims, costs, proceedings, demands, losses, damages, expenses or liability whatsoever arising directly or
indirectly as a result of any breach or non-performance of any representation, warranty or other terms herein contained or implied by law, as a result of your copy.
17. The placing of an order for insertion of an advertisement shall amount to an acceptance of these terms and conditions. Any terms and conditions stipulated on an order form
or elsewhere by you shall be void insofar as they are inconsistent with these conditions.
